Last updated: September 30, 2026
Overview
This website is operated by Nextgen Capital Group B.V., trading as Creaselle. Throughout these Terms of Service, “Creaselle,” “we,” “us,” and “our” refer to Nextgen Capital Group B.V.
These Terms govern your access to and use of our website, including its information, tools, products, and services, collectively referred to as the “Services.”
By using our website or placing an order, you agree to these Terms and the policies referenced within them. If you do not agree, you should not use the Services.
Our store is hosted on Shopify, which provides the ecommerce platform that enables us to sell products to you.
Nothing in these Terms limits consumer rights that cannot lawfully be excluded or restricted.
1. Using Our Online Store
To place an order, you must be of legal age to enter into a binding contract in your place of residence.
You may use our website and products only for lawful purposes. You must not use the Services in a way that infringes another person’s rights or violates applicable laws.
You must not upload or transmit viruses, malicious software, or other code intended to damage, disrupt, or gain unauthorized access to our Services.
We may suspend or restrict access where reasonably necessary to address a breach of these Terms, security concerns, or unlawful activity.
2. General Conditions
We may refuse or restrict Services where there is a legitimate reason, including suspected fraud, unlawful activity, misuse of the website, or a breach of these Terms, subject to applicable law.
Unless otherwise stated, website content belongs to us or our licensors. You may not reproduce, distribute, sell, or commercially exploit our content or Services without prior written permission, except where permitted by law.
Information transmitted online may pass through different networks and undergo technical adjustments. Payment information is handled through our payment providers. Please do not send payment card details or passwords by email.
Section headings are provided for convenience and do not change the meaning of these Terms.
3. Website Information
We aim to keep the information on our website accurate and current. However, occasional errors or omissions may occur.
General educational content is provided for informational purposes and is not individualized professional advice.
We may update website content as products, availability, or other circumstances change. Historical information, where provided, is for reference.
Nothing in this section excludes our responsibility for product descriptions, representations, or other information where applicable law requires us to be responsible for them.
4. Changes to Services and Prices
Product prices, promotions, and availability may change.
Changes apply prospectively and do not alter the price of an order we have already accepted, except where a correction is permitted by applicable law and handled in accordance with Section 11.
We may update, suspend, or discontinue website features or products. Where a change affects an existing order or contractual obligation, we will communicate with you and provide any remedy required by law.
5. Products, Shipping, and Returns
Some products may be available exclusively online or in limited quantities. We may limit order quantities or delivery destinations for legitimate operational reasons.
We make reasonable efforts to display product images and colors accurately. Actual appearance may vary depending on your screen and device settings.
Please review the product description and instructions before purchasing or using a product. Use products according to the instructions provided.
Our Shipping Policy explains processing times and estimated delivery periods. Our Return Policy explains eligibility, return procedures, and refund arrangements. These policies form part of these Terms, subject to applicable consumer law.
Statements about individual experiences do not guarantee that every customer will experience the same outcome. This does not limit any express product promises or statutory rights.
6. Orders, Billing, and Account Information
You agree to provide accurate, complete, and current information when placing an order or creating an account. Please keep your contact and delivery details up to date so we can process your purchase and communicate with you.
You are responsible for keeping your account login details confidential and notifying us if you suspect unauthorized use.
We may decline or cancel an order where permitted by law, including where there is suspected fraud, an inability to verify payment, a stock shortage, or a significant pricing error.
We may also apply reasonable quantity limits, including restrictions on orders that appear to be intended for unauthorized resale.
If we cancel an order, we will notify you using the contact details supplied and refund any payment collected for the cancelled items.
7. Optional Third-Party Tools
Our website may offer access to tools or features supplied by third parties.
These tools may be subject to the provider’s own terms and privacy policies. Please review those documents before using the tools.
We do not control independent third-party tools and cannot guarantee their continuous availability or suitability for your needs. Any limitation of our responsibility applies only to the extent permitted by law.
New tools or features introduced through our website will also be subject to these Terms and any additional terms disclosed when they are offered.
8. Third-Party Links
Our Services may include links to websites, content, or services operated by third parties.
A link does not necessarily imply our endorsement. We do not control independent third-party websites or their content, policies, or business practices.
Before purchasing from or providing information to a third party, review its terms and privacy policy. Questions about purchases made directly from another business should be directed to that business.
This section does not exclude any responsibility we may have under applicable law.
9. Reviews, Feedback, and Submissions
You may choose to submit reviews, comments, suggestions, or other content.
You retain ownership of your submissions. For content you submit for public display, such as product reviews, you grant us a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, and format that content in connection with our Services and marketing, subject to applicable law and your privacy rights.
We will not knowingly edit a review in a way that misrepresents your experience. Private customer support messages are handled under our Privacy Policy and are not treated as public reviews.
Your submissions must be truthful and must not:
-
Infringe another person’s intellectual property or privacy rights.
-
Contain unlawful, threatening, defamatory, or abusive material.
-
Include malicious code or misleading information.
-
Impersonate another person or misrepresent their source.
We may moderate or remove content that violates these requirements. We are not obliged to publish every submission, compensate you for unsolicited suggestions, or respond to every comment.
10. Personal Information
Our collection and use of personal information are described in our Privacy Policy.
Please review that policy to understand how information is collected, used, shared, and retained, and how to exercise applicable privacy rights.
11. Errors, Inaccuracies, and Omissions
Our website may occasionally contain errors relating to product descriptions, prices, promotions, shipping charges, delivery estimates, or availability.
We may correct these errors when discovered. If an error materially affects an order you have placed, we will contact you to explain the issue and, where appropriate, offer you the choice of proceeding on the corrected basis or cancelling for a refund.
We will not impose an additional charge without your agreement. Any cancellation or correction remains subject to applicable law.
12. Prohibited Uses
You must not use our website or Services to:
-
Break the law or encourage unlawful conduct.
-
Infringe our intellectual property rights or those of others.
-
Harass, threaten, abuse, or unlawfully discriminate against another person.
-
Submit fraudulent or deliberately misleading information.
-
Upload malicious software or interfere with website functionality.
-
Obtain unauthorized access to accounts, systems, or networks.
-
Collect or misuse another person’s personal information.
-
Send spam, phishing messages, or other deceptive communications.
-
Circumvent security measures.
-
Use automated tools in a way that disrupts the Services or unlawfully extracts protected content or personal information.
We may restrict access or take other proportionate action where we reasonably believe these rules have been breached.
13. Warranties and Limitation of Liability
We do not guarantee that the website will always be available, uninterrupted, or free from technical errors. We may temporarily suspend access for maintenance, updates, or security reasons.
To the extent permitted by law, website tools and general informational content are provided on an “as available” basis.
Nothing in these Terms excludes or restricts statutory product guarantees, warranties, or remedies that apply to your purchase.
To the extent permitted by law, we are not responsible for indirect or consequential losses, including loss of business profits, arising from use of the Services.
These limitations do not apply to fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot legally be excluded or limited.
Where applicable law does not allow a particular exclusion or limitation, that exclusion or limitation will not apply.
14. Responsibility for Third-Party Claims
To the extent permitted by applicable law, you agree to indemnify Nextgen Capital Group B.V. and its personnel against reasonable third-party claims, losses, and costs directly resulting from your unlawful use of the Services, your infringement of another person’s rights, or your intentional or negligent material breach of these Terms.
This obligation does not apply to losses caused by our own breach, negligence, or misconduct, and does not override mandatory consumer protections.
Where such a claim arises, we will notify you and provide a reasonable opportunity to participate in its resolution.
15. Severability
If any provision of these Terms is found to be unlawful or unenforceable, it will be removed or limited only to the extent necessary.
The remaining provisions will continue to apply, provided the agreement can reasonably operate without the affected provision.
16. Suspension and Termination
You may stop using our Services at any time. To request closure of a customer account, contact info@creaselle.com.
We may suspend or terminate access where reasonably necessary because of a material breach of these Terms, suspected fraud, security risks, or a legal requirement.
Where appropriate and legally required, we will provide notice and an opportunity to resolve the issue.
Termination does not remove payment obligations already validly incurred, affect rights relating to existing purchases, or eliminate refund obligations. Provisions intended to continue after termination will remain effective to the extent permitted by law.
17. Entire Agreement
These Terms, together with the policies expressly incorporated into them and any applicable order-specific terms, form the agreement governing your use of the Services.
A failure or delay in enforcing a provision does not waive our right to enforce it later.
Nothing in this section excludes liability for misrepresentation or removes rights arising from statements that applicable law makes binding.
18. Applicable Law and Consumer Rights
These Terms are subject to applicable United States federal and state law.
If you purchase as a consumer in another country, you may also benefit from mandatory protections under the laws of your place of residence. Nothing in these Terms removes those protections or restricts your right to bring a claim before a court available to you under applicable law.
19. Updates to These Terms
We may update these Terms to reflect changes to our Services, business practices, or legal requirements.
The current version will be available on this page, together with its last updated date. Where required by law, we will provide additional notice or obtain your agreement to material changes.
Unless otherwise agreed or required by law, the Terms in effect when your order was placed will govern that purchase. Updated Terms apply to future use of the Services.
